Eligible Transaction |
Any settled cross-border payment transaction processed on VisaNet (“XB Transaction”, “Eligible Transaction”) made by an Eligible Customer using an Eligible Card; provided, however, any digital wallet ‘add money’ and pass-through transactions shall not fall within the definition of ‘XB Transaction’ or ‘Eligible Transaction’; provided, further, both e-commerce or online and point-of-sale or face-to-face transactions will be considered within the definition of, ‘XB Transaction’ or ‘Eligible Transaction’.

Eligible Transaction Restrictions |
The restrictions on the Eligible Transactions are listed below: (a) Only the first 10 (Ten) Eligible Transaction in a day on the same merchant will qualify as Eligible Transactions and rest of such transactions shall be excluded from Ranking. (b) Eligible Transactions with the following merchant category codes (MCCs) will be excluded for the purposes of Ranking: (Wallet Load / Add Money / Pass-through): MCC 6540, 6012, 6010. |

Promotion Mechanics |
1. winners,e Customers shall be ranked basis the cumulative value of settled cross border transactions processed by Visa net across all Visa members in the Territory participating in the Promotion during the Promotion Period (“Ranking”) where the Eligible Customer with the maximum value of settled cross border transactions processed by Visanet shall be ranked 1st and so on provided the top 5 (five) ranked customers have individually spent at least USD 2000 (or equivalent currency other than BDT) and the next 30 winners i.e., ranked 6th to 35th have individually spent USD 1000 (or equivalent currency other than BDT) during the campaign period. 2. Promotion: 3. After one month of the campaign end date, the top 35 Eligible Customers basis the Ranking achieved by the Eligible Customer during the campaign period shall receive the award (“Award Winners”).
4. The prize shall be as follows: (a) As stipulated under Appendix [A]. 5. The Parties agree that: (a) The Final Winners would be determined on the basis of the cumulative cross border spends volume at the end of the Promotion Period basis the Ranking (b) The number of Eligible Transactions that are cancelled or unsuccessful (for any reason whatsoever) will not be considered for the determination of the total Points earned by such Eligible Customer basis the Ranking. (c) Any payment transaction using equated monthly installments will not be considered for the purposes of this Promotion as an ‘Eligible Transaction’. (d) In the event multiple Eligible Customers spend the same volume at the end of the Promotion Period basis the Ranking the Eligible Customer whose aggregate / cumulative transaction count is higher will be selected. 6. The Final Winners would be announced within [30] days after the end of the Promotion Period. 7. If the Eligible Customer(s) of the Business Partner wins Final Prize(s), Visa shall provide such applicable Final Prize(s) to the Business Partner. 8. If the Eligible Customer(s) of the Business Partner wins Final Prize(s), within [30] days from the end of the Promotion Period, the Business Partner shall contact the Final Winners via e-mails to their respective e-mail address registered with the Business Partner’s account. The Final Winner must respond with their acceptance of the respective prizes within [15] days of the e-mail, failing which the applicable Final Winner shall be considered to have forfeited his/her applicable prize. In the event of such forfeiture, the next Eligible Customer basis the Ranking shall be chosen in accordance with the applicable criteria. In such a scenario, with respect to the Final Winner, the next Eligible Customer basis the Ranking shall be chosen only up to the next [3] succeeding Eligible Customers (beyond which the relevant Final Prize will not be provided and will be recalled / cancelled). For the avoidance of doubt, if the Eligible Customer determined to be the Final Winner basis the Ranking does not confirm acceptance of the Final Prize or is otherwise not eligible then the Eligible Customer previously determined to have spent the second highest cross border volume shall be eligible for such Final Prize and the next in line Eligible Customers starting with the [2nd] highest volume of cross border spends at the end of the Promotion Period basis the Ranking shall be eligible for the other Final Prizes, and so on and so forth. 9. The Promotion shall be made available to the Eligible Customer in accordance with the terms and conditions set forth in Appendix 1 hereto. The terms and conditions set forth in Appendix 1 hereto set forth the terms of the Promotion as applicable in respect of the Eligible Customer. Business Partner shall cause the said terms and conditions to be communicated to the Eligible Customer. |
